Terms of Service

Welcome to Fluentale. These Terms of Service (the “Terms”) form a binding agreement between you and Fluentale. They govern your use of the Fluentale mobile app, the fluentale.app website, and any related services (together, the “Service”). Please read them carefully. By creating an account or using the Service, you agree to these Terms.
1. Eligibility and minors
You must be at least 13 years old (or the minimum age required in your country) to use Fluentale. If you are under the age of majority where you live, you may only use the Service with the consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your activity on the Service.
Fluentale is not designed for children under 13 and we do not knowingly create accounts for them. If you believe a child has created an account, contact us at contact@fluentale.com and we will remove it.
2. Your account
You may create a Fluentale account using an email address or a third-party sign-in (such as Sign in with Apple or Google). You are responsible for keeping your login credentials secure and for any activity that happens under your account. You agree to provide accurate information and to keep it up to date.
Account deletion. You can permanently delete your account at any time directly from inside the Fluentale app, in “Settings > Account > Delete account”, or by emailing contact@fluentale.com. Deletion removes your personal data within 30 days, except for information we are legally required to keep.
3. The Service
Fluentale provides a gamified, RPG-style language learning experience, including lessons, quests, combat mechanics, streaks, leaderboards and community events. We are constantly improving the Service, which means we may add, change or remove features at any time. Some content, heroes, cosmetics or events may only be available to Premium subscribers or for a limited time.
4. Premium subscriptions and auto-renewal
Fluentale is free to use. Some features are available through an optional Premium subscription. Subscriptions purchased on iOS are billed by Apple through your App Store account. Subscriptions purchased on Android are billed by Google through your Google Play account. Prices, durations and the products available are shown on the in-app paywall before you confirm your purchase.
Auto-renewal (Apple App Store).
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
- Subscriptions may be managed and auto-renewal may be turned off by going to your Apple ID Account Settings after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.
Free trials. When a free trial is offered (for example, a 7-day Premium trial), the trial automatically converts into a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. Cancellation is done in your Apple ID Account Settings or in your Google Play subscriptions.
Refunds and right of withdrawal. Refunds are handled by Apple or Google according to their refund policies. If you live in the European Union, the European Economic Area or the United Kingdom, you have a statutory right to withdraw within 14 days of purchase, subject to applicable consumer law. By starting to use Premium content during the withdrawal period you may lose this right, in which case we will inform you clearly before you confirm the purchase.
5. Apple End User License Agreement
The Fluentale iOS app is licensed, not sold, to you. Your license to the iOS app is governed by Apple’s standard End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ (the “Apple EULA”). The Apple EULA applies in addition to these Terms. In the event of a conflict between these Terms and the Apple EULA in respect of the iOS app, the Apple EULA prevails for the relevant clauses.
You acknowledge that Apple has no obligation to provide maintenance and support services for the Fluentale iOS app, and that Apple is not responsible for addressing any claims relating to the app or your possession and/or use of it. Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms with respect to the iOS app.
6. In-app currencies and items
Fluentale may offer virtual items such as gems, coins, chests, relics or cosmetics. These items have no monetary value, cannot be exchanged for real money, and are non-transferable. We may modify, regulate, or remove virtual items at any time, including for game balance reasons.
7. Acceptable use and zero-tolerance policy
We expect Fluentale to remain a safe and welcoming place. You agree not to:
- Use the Service in a way that violates any law or these Terms.
- Cheat, exploit bugs, automate gameplay, or otherwise interfere with the integrity of the Service.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Submit content that is unlawful, threatening, hateful, harassing, sexually explicit, or that infringes on third-party rights.
- Impersonate another person or organization, including Fluentale staff.
- Use the Service to spam, scrape, or collect personal data about other users.
We have a zero-tolerance policy for objectionable content and abusive behaviour. You can report any user, message or piece of content from inside the app or by emailing contact@fluentale.com. We aim to review and act on reports within 24 hours, including by removing the content and/or banning the user.
8. User content
You retain ownership of any content you submit through the Service (for example, a username, profile, feedback, or messages in community features). By submitting content, you grant Fluentale a worldwide, non-exclusive, royalty-free license to host, store, display and otherwise use that content as needed to operate, promote and improve the Service.
9. Intellectual property
All software, illustrations, characters, music, sound effects, lesson content, and brand elements that make up Fluentale are owned by Fluentale or licensed to us. We grant you a personal, non-exclusive, non-transferable, limited license to use the Service for your own non-commercial language learning. You may not copy, redistribute or modify Fluentale content without our written permission.
10. Termination
You may stop using Fluentale at any time and delete your account from inside the app or by emailing us. We may suspend or terminate your access to the Service if you breach these Terms, if your account presents a security risk, or if we are required to do so by law. We will give you notice when reasonably possible. Sections that by their nature should survive (intellectual property, limitation of liability, governing law) continue to apply after termination.
11. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Fluentale disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific learning outcome will be achieved.
12. Limitation of liability
To the maximum extent permitted by law, Fluentale will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profit or goodwill, arising out of your use of the Service. Our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) twenty euros (€20). Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.
13. Changes to these Terms
We may update these Terms from time to time. If the changes are significant, we will let you know in the app or by email at least 14 days before they take effect. Continuing to use the Service after the changes take effect means you accept the updated Terms. The “effective date” at the top tells you when the current version was published.
14. Governing law and disputes
These Terms are governed by French law, without regard to its conflict-of-law rules. If you are a consumer living in the European Union, the European Economic Area, or the United Kingdom, you also benefit from the mandatory consumer protection rules of the country where you live, including the right to bring proceedings before the courts of that country.
